Estimate Damage For patent infringement cases

I would love to know how to approach cases where I'm required to estimate damages to client because a competitor copied their product.

If you have a concrete prompt, that would be great as we can then provide a more tailored answer. This problem could either be a more qualitative case or an estimation case based on how the question is framed.

I believe this would rather be an estimation case.

In that case, you could simply size the market, and then estimate the chunk the competitor is taking away from you with this product. All relatively straightforward quantitatively speaking.

What is crucial here to demonstrate are the right assumptions like for the market size, the rationale for and business sense to judge the impact, e.g., how long will the infringement last until it is settled in court, etc.

Extra points for being creative here, e.g., showing that the infringement can also have positive effects on the client business due to market growth, more awareness, etc.

Before approaching the structure - btw - I'd also spend some time upfront discussing with the interviewer what they mean by damages. Are we only talking about financial damage or also softer things like brand?
